Acceptable Use Policy
This Acceptable Use Policy (the “AUP”) is incorporated by reference into the Terms of Service and governs your use of the ShipEasy Shopify app (the “App”) and the freight brokerage services provided by Provenance SCS Inc., doing business as “ShipEasy”.
Violation of this AUP is grounds for immediate suspension or termination of the Service under Terms § 20, and may expose you to liability under the indemnification provisions of Terms § 18.
1. Prohibited freight
You may not use the App to quote, book, tender, or otherwise arrange the transportation of any of the following:
1.1 Federally regulated and hazardous materials
- Hazardous materials as defined in 49 C.F.R. Parts 171–180, except where the Merchant holds a current hazmat shipper registration with the U.S. DOT and the selected Carrier has confirmed in writing that it will accept the specific UN-numbered commodity. Even where permitted, hazmat shipments require a separately negotiated Carrier rate; the App’s standard quoting flow is not authorised for hazmat tenders.
- Explosives (UN Class 1) in any quantity.
- Radioactive materials (UN Class 7) in any quantity.
- Infectious substances (UN Class 6.2 Category A).
- Self-defence sprays, lithium-ion battery shipments exceeding the limited-quantity exception, and other regulated electronics requiring Carrier-specific declarations.
1.2 Firearms, ammunition, and weapons
Firearms, ammunition, firearm parts (including frames and receivers), suppressors, and any item regulated under the U.S. National Firearms Act (26 U.S.C. ch. 53) or the Gun Control Act of 1968.
1.3 Controlled substances and pharmaceuticals
- Controlled substances scheduled under the U.S. Controlled Substances Act (21 U.S.C. § 812) in any schedule.
- Prescription pharmaceuticals, cannabis or cannabis-derived products (including hemp products exceeding 0.3% Δ9-THC), kratom, and tobacco products requiring age verification.
1.4 OFAC and sanctions
- Goods, destinations, or end users subject to economic or trade sanctions administered by the U.S. Office of Foreign Assets Control (“OFAC”), the U.S. Department of Commerce Bureau of Industry and Security, the U.S. State Department Directorate of Defense Trade Controls, or any equivalent foreign authority.
- Shipments to or from countries subject to comprehensive U.S. sanctions (currently Cuba, Iran, North Korea, Syria, and the Crimea / Donetsk / Luhansk regions of Ukraine).
1.5 Counterfeit, infringing, or stolen goods
- Counterfeit goods or goods bearing a counterfeit trademark.
- Goods that infringe any third party’s patent, trademark, copyright, or trade-secret rights.
- Goods you know or have reason to know to be stolen.
1.6 Live animals, human remains, perishables that require special handling
- Live animals of any kind.
- Human remains, ashes, or biohazardous waste.
- Temperature-sensitive perishables, blood products, or organ shipments — these require a reefer / cold-chain Carrier service not currently offered through the App.
1.7 Other restricted commodities
- Currency, bullion, precious stones, negotiable instruments, or other items of “extraordinary value” as defined in the Carrier’s tariff.
- Original works of art, antiques, or one-of-a-kind items where the replacement cost exceeds the released-value coverage and the Merchant has not arranged separate shipper’s-interest insurance (see Terms § 15).
- Goods prohibited or restricted by the selected Carrier’s published tariff or by applicable law.
2. Service-abuse prohibitions
You may not, and you may not permit any third party to:
- use the App to make a number of API calls or rate-quotation requests that exceeds the limits set under Terms § 6.1, or otherwise interferes with the stability or performance of the Service for other merchants;
- scrape, harvest, or otherwise extract Carrier rates, transit times, or service-level data for use outside the Booking flow (including for resale, benchmarking, or competitive intelligence);
- reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, or algorithms underlying the Service;
- bypass, disable, or otherwise circumvent any security feature of the Service, including authentication, rate-limiting, or audit-log facilities;
- introduce malware, viruses, worms, time bombs, or any other malicious code through the App or to Shopify or any Carrier API;
- use the App to send unsolicited communications, spam, phishing attempts, or fraudulent notices;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- use the Service in connection with any benchmarking or development of a product or service that competes with the App; or
- use the Service in violation of any applicable U.S. federal, state, or local law or regulation, or any applicable international law.
3. Accurate information
You represent that the information you submit through the App — including origin and destination addresses, package dimensions, weights, NMFC freight classifications, accessorial requirements, and any hazardous-material declarations — is accurate and complete. Inaccurate information is a material breach of this AUP and is grounds for back-billing the Merchant for any resulting reweigh, reclassification, or accessorial charges as permitted under Terms § 8.3.
4. Carrier-specific rules
Each Carrier maintains its own tariff, BOL terms, and acceptance policies. The Carrier’s published rules govern over this AUP where they are more restrictive. The Merchant is responsible for reviewing and complying with the rules of the selected Carrier before tendering a shipment.
5. Reporting violations
If you become aware of any actual or suspected violation of this AUP, please report it to security@shipeasyco.com. ShipEasy investigates AUP reports promptly and may take action including suspension or termination of the offending account.
6. Consequences of violation
Violations of this AUP may result in any or all of the following, in ShipEasy’s sole discretion:
- Immediate suspension of the Merchant’s access to the Service pending investigation;
- Termination of the Agreement and the Merchant’s access to the Service under Terms § 20;
- Back-billing of any reweigh, reclassification, accessorial, fine, or penalty resulting from the violation;
- Referral of the violation to the affected Carrier, Shopify, and / or law enforcement; and
- Forfeiture of any refund right under Terms § 9.
ShipEasy is not obligated to give advance notice before suspending or terminating an account for a serious violation of this AUP.
7. Changes to this AUP
For material changes, we will notify merchants by an in-app notice or email at least 30 days before the new version takes effect.
